Construction Claims Experience
Since 1986 Clark has represented general contractors, sureties, subcontractors, owners, and design professionals in construction claims. Most of these cases were resolved out of court. The
following are a few examples of the types of clients Clark has represented in disputes that were resolved by mediation or other
forms of alternative dispute resolution (ADR):
- Contractor in mediation of adjacent landowners' flood damage claims against school district and district's claims against contractor and engineer
- Surety in ADR of principal-contractor's delay and disruption claim against school district and district's claims against contractor and engineer
- Roofing contractor in mediation of condominium association's claim for defective roof
- Residential owner in arbitration of contractor's claim for payment
- Contractor in ADR of delay claim against state building agency; collaborated with counsel for agency and its engineer to develop protocol for submission of claim to expert for recommended resolution
- Surety in mediation of claim on subdivision development bond; dispute involved county and successor developer
Mediation Training and Volunteer Work
Clark's mediation training includes Utah Dispute Resolution Basic Mediation Training and Program of Instruction for Lawyers at Harvard Law School's Program on Negotiation. He actively continues to obtain education and training in both law an dmediation. Clark has also mediated debt collection matters in Third District Court for Salt Lake County and a variety of disputes
in small claims court as a volunteer mediator.
